1. Who you are contracting with

These terms are between you and The Travelist Co ("The Travelist", "we", "us"), trading as The Travelist. By using this website or purchasing any of our products or services, you agree to be bound by these terms.

2. Our services

The Travelist provides curated travel content, including downloadable city guides, a drag-and-drop itinerary builder, and custom itineraries curated by our team. Some content is free; some requires a one-time purchase.

3. Payments and merchant of record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation and refund mechanics, please refer to the Paddle Buyer Terms.

4. Your account

You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date. You must be old enough to enter a binding contract in your country of residence.

5. Acceptable use

You must not misuse the service. In particular, you must not:

  • use the service for any unlawful, fraudulent, or abusive purpose;
  • infringe anyone's intellectual property or privacy rights;
  • interfere with the security or integrity of the service (malware, probing, scraping, denial of service);
  • resell, redistribute, or sublicense our content without written permission.

6. Intellectual property

All content, guides, itineraries, branding and software on this site are owned by The Travelist Co or its licensors. You get a limited, non-exclusive, non-transferable right to use purchased content for your personal, non-commercial travel planning. You may not reverse engineer or circumvent any technical limits of the service.

7. User content

When you save trips, add notes, or upload content, you grant us a limited licence to host and process that content solely to provide the service to you.

8. Service level

We work hard to keep the service available, but we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access if you materially breach these terms, fail to pay, create a security or fraud risk, or repeatedly violate our policies. On termination, your right to use purchased content ends and any personal data will be handled per our Privacy Notice.

10. Liability

To the fullest extent permitted by law, our aggregate liability to you for any claim arising out of these terms is capped at the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury caused by our negligence where such limitation is prohibited by law.

11. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.

12. Changes

We may update these terms from time to time. Material changes will be notified through the service or by email. Continued use after changes means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the jurisdiction in which The Travelist Co is established, and disputes will be resolved in the courts of that jurisdiction, unless a mandatory local law gives you the right to sue in your own country.
